We reserve the right to amend these conditions at any time. These conditions cover our web design service and the use of our website and its social media and forum platforms.

Definitions:
The Client: The company or individual requesting the services of PCpetes.
PCpetes: Primary designer/site owner & Administrator of design services.


Website Design Terms and Conditions

  1. General
    PCpetes will carry out web design work where an agreement is provided by either email, telephone or in person. An ‘order’ is deemed to be a written or verbal contract between PCpetes and the client. This includes telephone and email agreements.

  2. The Design Process
    Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, PCpetes cannot accept  responsibility for any losses incurred due to program malfunction of the website or any part of it.

    The website, graphics and any programming code remain the property of PCpetes or their respective copyright holders.
    Any scripts, cgi applications, php scripts, or software, (unless  specifically agreed), written by PCpetes remain the copyright of PCpetes or their respective copyright holders and may only be commercially reproduced or resold with the permission of PCpetes.

    PCpetes cannot take responsibility for any copyright infringements caused by materials submitted by the client or otherwise. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

  3. Compatibility
    PCpetes will endeavour to ensure that any developed/designed site or application will function correctly on the server when it is initially installed and that it will function correctly when viewed with the web browsing software to an acceptable level with the past 2 versions of Internet Explorer, Google Chrome and Firefox browsers. PCpetes can offer no guarantees of correct function with all browser software.


  4. Website Hosting
    Whilst Roslin Design provides website hosting services, no guarantees can be made as to the availability or interruption of this service. PCpetes cannot accept liability for losses caused by the unavailability, malfunction or interruption of this  service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

    PCpetes reserves the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate the hosting service should the necessity arise.

    If Payments for any hosting contracts through us are not paid by the end of a 1 month notification period, PCpetes reserves the right to terminate the hosting contract and any third party related services in connection with contract.

  5. Payment of Accounts
    It is PCpetes policy that any outstanding accounts for work carried out by PCpetes or its affiliates are required to be paid in full, no later than 28 days from the date of the invoice unless by prior arrangement with PCpetes.

    Once work is completed you are obliged to pay the balance of payment in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due. If accounts are not settled or Pcpetes have not been contacted regarding the delay, access to the  related website may be denied and web pages removed, we will then pass such cases to the Small Claims Court to pursue payment.

    Following consistent non payment of an invoice our Solicitors will contact the client in question, with a view to taking the matter further and if need be to seek payment through legal procedures, and if necessary court summons.

  6. Responsive Compatibility
    Although we do not guarantee compatibility on any device or browser, we strive to build our websites to be compatible with the most common modern browsers  including the latest versions of Firefox, Google Chrome, and Internet  Explorer version 8 and above.

  7. If you are unhappy with your site
    Anyone who experiences a problem with their web service should raise the matter directly with us using our online Contact Form to do so, giving sufficient information to locate the material, (such as an url), and clearly outlining the grounds for complaint.

    PCpetes will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.

  8. Web Design Completion Time
    We would normally expect to complete a design project in a time frame relating to its size and complexity, and will agree a time scale with the client in relation to this. Any changes to design or amendments to design will not be maintained in the same given time scale. Any delays caused by third parties will not be held as our responsibility.

    Please  note that all expected completion times are measured from the time at  which we receive all the material required to complete the work.
    This  material may include text, imagery, video, or any other information  needed to complete the job, such as questionnaire responses, answers to  queries, access to hosting, etc. If we haven’t received all the  information we have requested, we will not start work on the project.

  9. Minor Amendments (less than 1 hour of design work)
    Should you request an update to your website that will take us less than 1 hour to complete, we will normally complete the update within 2 working days.


Use of this web site

By accessing or using the Site, you are accepting these Terms (on behalf of yourself or the entity that you represent), and you represent and warrant that you have the right, authority, and capacity to enter into these Terms (on behalf of yourself or the entity that you represent).you may not access or use the Site if  you do not agree with all of the provisions of these Terms, do not access and/or use the Site.

  1. a Account Creation.
    In order to use certain features of the Site, you must register for an account (“Account”) and provide certain information about yourself as prompted by the account registration form. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information. You may delete your Account at any time, for any reason, by following the instructions on the Site

    b.
    Account Responsibilities.You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account.You agree to immediately notify Crowdfire of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security.Crowdfire cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

    c. Modification.
    PCpetes reserves the right, at any time, to modify, suspend, or discontinue the Services (in whole or in part) with or without notice to you. You agree that PCpetes will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services or any part thereof including termination of any user accounts.       

    d. Ownership.
    Excluding any Customer Content that you may provide (defined below), you acknowledge that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Services and its content are owned by PCpetes or its suppliers. Neither these Terms (nor your access to the Services) transfers to you or any third party any rights, title or interest in or to such intellectual property rights. PCpetes and its suppliers reserve all rights not granted in these Terms.There are no implied licenses granted under these Terms.   

    e.Customer Content. Meaning: any and all information and content (including text, images, photos, videos, audio, and documents) that a Customer provides or makes available to PCpetes in connection with the use of the Services. You are solely responsible for your Customer Content. You assume all risks associated with use of your Customer Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your Customer Content that personally identifies you or any third party.

    You hereby represent and warrant that your Customer Content does not violate our Acceptable Use Policy. You may not represent or imply to others that your Customer Content is in any way provided, sponsored or endorsed by PCpetes. You alone are responsible for your Customer Content, you may expose yourself to liability if, for example, your Customer Content violates the Acceptable Use Policy. PCpetes is not obligated to backup any Customer Content, and your Customer Content may be deleted at any time without prior notice. You are solely responsible for creating and maintaining your own backup copies of your Customer Content if you desire.      

    f. Acceptable Use Policy.The following terms constitute our “Acceptable Use Policy”:           
                  
    1. You agree not to use the Services to collect, upload, transmit, display, or distribute any Customer Content (i) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual or is otherwise objectionable; (iii) that is harmful to minors in any way; or (iv) that is in violation of any law, regulation, or obligations or restrictions imposed by any third party.

In addition, you agree not to: (i) upload, transmit, or distribute to or through the Services any computer viruses, worms, or any software intended to damage or alter a computer system or data; (ii) send through the Services unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (iii)use the Services to harvest, collect, gather or assemble information or data regarding other Customers, including e-mail addresses, without their consent; (iv) interfere with, disrupt, or create an undue burden on servers or networks connected to the Services, or violate the regulations, policies or procedures of such networks; (v) attempt to gain unauthorized access to the Services (or to other computer systems or networks connected to or used together with the Services); or (vi) harass or interfere with any other Customer’s use and enjoyment of the Services.

      e. Enforcement.
      We reserve the right (but have no obligation) to review any Customer Content, and to investigate and/or take appropriate action against you in our sole discretion if you violate the Acceptable Use Policy or any other provision of these Terms or otherwise create liability for us or any other person. Such action may include removing or modifying your Customer Content, terminating your Account and/or reporting you to law enforcement authorities.   

      f. Disclaimers         
      THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS, AND PCPETES (AND OUR SUPPLIERS) EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT.

      WE (AND OUR SUPPLIERS) MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE. IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE SITE, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF FIRST USE.

      PCPETES DISCLAIMS ANY AND ALL RESPONSIBILITY OR LIABILITY IN RELATION TO THE CONTENT MADE AVAILABLE THROUGH THE SERVICES, INCLUDING THE CUSTOMER CONTENT, OR ANY CONTENT OR SERVICES PROVIDED BY THIRD PARTIES. PCPETES DOES NOT CONTROL OR VET CUSTOMER CONTENT AND IS NOT RESPONSIBLE FOR WHAT USERS POST, TRANSMIT, OR SHARE ON OR THROUGH THE SERVICES. PCPETES IS NOT RESPONSIBLE OR LIABLE IN ANY MANNER FOR ANY THIRD-PARTY SERVICES ASSOCIATED WITH OR UTILIZED IN CONNECTION WITH THE SERVICES, INCLUDING THE FAILURE OF ANY SUCH THIRD-PARTY SERVICES OR SUPPORTED PLATFORMS.

      g. Limitation on Liability         
      TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PCPETS (OR OUR SUPPLIERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOST DATA, COSTS OF PROCUREMENT OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF PPETES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

      ACCESS TO, AND USE OF, THE SITE IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM.
